Richard T. Lauer

Rick Lauer has been named one of Ohio's Super Lawyers - Rising Stars, featuring the top 2.5 percent of attorneys in Ohio in 2006 and 2007. Ohio Super Lawyers - Rising Stars are chosen by their peers as being among the top up and coming lawyers under the age of 40. The selection process includes peer nominations and independent research on candidates. Rick was chosen for his work in commercial and general litigation and in real estate.

In November 2006, Rick Lauer negotiated a settlement of $275,000 on behalf of a client who was injured in an automobile accident. The client suffered several fractured ribs and compression fractures in her spine requiring surgery. The defense originally claimed that the spine fractures were unrelated to the accident, but after reviewing the medical report of the physician Mr. Lauer retained to evaluate the case, changed its position and agreed to settle the claims for their full value to avoid trail.

In January 2007, a Butler County, Ohio jury awarded a 22 year-old college student more than $85,000 for injuries he sustained in an automobile accident. The young man was represented by Rick Lauer. The jury's verdict, which included more than $60,000 in compensation for future damages, was six times greater than the last settlement offer the insurance company made to Mr. Lauer's client.

On May 17 2007, Rick Lauer was the featured speaker at a luncheon hosted by the Real Estate Committee of the Cincinnati Bar Association, Rick discussed recent developments in land use law, and a much-publicized zoning case in which he represents a local municipality that has attempted to prevent the redevelopment of a golf course. Rick represents property owners and local governments in real estate related disputes and transactions.

In December 2007, Rick Lauer negotiated a settlement of more than $450,000 for a client who was seriously injured by an uninsured motorist. Mr. Lauer's client, a former police office, suffered injuries to her back and hip when a suspect fled during a traffic stop, dragging the police office 30 feet before she was thrown from the suspect's vehicle. The officer originally contacted Mr. Lauer to discuss employment related benefits, but during the course of his investigation, Mr. Lauer discovered that she was entitled to coverage under a large automobile insurance policy provided by her employer.

During the December 2007 Real Property Institute seminar, Rick Lauer presented Trends in Zoning Law in the Post - Norwood Era to a large crowd of attorneys, judges ad real estate professionals. Mr. Lauer reviewed judicial decisions published since the Ohio Supreme Court's landmark decision limiting the power of municipalities to use eminent domain for economic development to determine whether courts have adopted the Norwood Court's reasoning to curtail the use of zoning regulations.

In June 2008, The Eleventh District Court of Appeals invalidated a local zoning ordinance banning billboards because it was in direct conflict with Ohio law. The decision in American Outdoor Advertising Company, LLC v. Franklin Township, Ohio overturned the decisions of the Franklin Township Board of Zoning Appeals and the Portage County Court of Common Pleas. Rick Lauer has represented American Outdoor Advertising Company, LLC since 1995, and was the attorney for the company in this important victory that protects Ohio property owners from overreaching by local government officials.
