Substantial Change in Circumstances or Lifestyle

As a general rule, divorce decrees are binding, unless the parties agree to a change or there is a substantial change in circumstances or lifestyle for one or both of the ex-spouses. Our attorneys represent clients in modification cases involving:

  • Spousal support modifications: When the receiving spouse gets in a more stable financial situation, or the paying spouse experiences a reduced ability to pay the support, the court would consider a modification of spousal support decree.
  • Child support modifications: The court can order an upward or downward modification of child support arrangements. Similar to spousal support, if the receiving parent experiences reduced need for support, or the paying spouse experiences reduced ability to make child support payments, the court will consider a downward modification. Conversely, the court will consider an upward modification if significantly increased need for support and ability to pay can be shown.
  • Child custody modifications: In the context of child custody/parenting time arrangements, a substantial change in circumstances usually involves a change in job, lifestyle or location. If one parent gets remarried, changes jobs or needs to relocate a significant distance, it will affect the other parent's visitation rights.
