Formerly called alimony, spousal support is simply the financial support that one spouse pays the other for food, shelter and other daily needs. Judges determine spousal support based on factors that include:
- The length of the marriage
- The work prospects for each party
- The time required for the receiving spouse to obtain education and training
- The ability of the paying spouse to pay spousal support
- The age and the health of the spouse seeking support
- The standard of living that both parties enjoyed during the marriage
Collaborative Law and Spousal Support
Although the judge has to authorize any spousal support arrangement, the terms of spousal support do not need to be decided by the judge. Collaborative law is a form of mediation in which the divorcing spouses can work out many of the issues that arise in their divorce, outside of the courtroom. This allows divorcing couples more control over the process and the specific terms of the spousal support arrangement, while saving time, money and stress in most cases.
