A dissolution is a non-adversarial process where both spouses jointly ask the court to end their marriage. The spouses present their written agreements to the court, along with a petition asking the court to dissolve their marriage. The agreement must address all issues relevant to their marital relationship, including child custody, parenting time, and support, as well as property division, debts, taxes, and fees. The court must then hold a final hearing on their petition between thirty and ninety days after it is filed.
There are several ways to reach agreements, including “kitchen table” discussions, which is an agreement reached by the parties with limited involvement of counsel. Once an agreement has been reached, an attorney for one of the parties will draft the final separation agreement and/or shared parenting plan. Other ways include mediation, lawyer negotiation and collaborative law, which offers a “no-court” alternative.
